For all deliveries of Onlinezoo to consumers these Terms and Conditions are valid. The contract language is German.

3. Offer and conclusion of contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to order. errors excepted.

3.2 By clicking the button "Place Order" in the last step of the ordering process, a binding order for the goods in your shopping cart. The purchase contract is concluded when we accept your order and sent an order confirmation via e-mail immediately after receiving your order.

5. Cancellation policy

Right of cancellation

Customers who are consumers within the meaning of the Austrian Consumer Protection Act, or similar legislation in their respective countries of residence, have the right to cancel this contract within 14 days without giving reasons. The cancellation period is 14 (fourteen) days from the date on which you or a third party nominated by you, other than the carrier, take possession of the goods.

within a unique declaration (e.g. a letter sent by mail, fax or email) of your decision to cancel this contract. You can optionally use the attached sample cancellation form. You can also fill out and submit the sample cancellation form or an other unique declaration, electronically, on our website (Sample cancellation form).

Once you have made use of this possibility, we will send you confirmation of the receipt of such cancellation by email. To guarantee the cancellation period it is sufficient to submit the notice of implementation of the right of cancellation before the cancellation deadline has expired.

Consequences of cancellation

If you cancel this contract, we are obliged to repay all payments that we have received from you including delivery charges (except for additional costs arising from choosing a different type of delivery to the cheap, standard delivery offered by us) without delay and at the latest within fourteen (14) days from the date on which the notice of cancellation of this agreement is received. We use the same means of payment for this repayment that you used in the original transaction, unless something else has been expressly agreed with you; in no instances will fees be charged for this repayment. We may refuse to refund payments until we have received the goods again or until you have demonstrated that you have returned the goods, whatever is sooner. You must return or hand over the goods promptly and in any case no later than fourteen days from the date on which you have informed us about the cancellation of this agreement. The deadline is guaranteed, if you send the goods before expiration of the fourteen day period. You must bear the direct costs of returning the goods.

 

The cost of returning goods shall habv to be payed by the byer.

6. Prices and delivery costs

6.1 The quoted prices include VAT and other price components.

6.2 The shipping costs depend on the amount of goods ordered, the weight, the size and the shipping and will be clearly informed before submitting your order. You will find a list on the page Shipping. Assembly or installation are not included.

6.3 For a delivery in the non-EU space of the consumer is responsible for all import and export duties and expenses as well as any fees and charges.

7. Shipment

7.1  Should we the customer's order for some reason can not fulfill the customer will be notified about it by e-mail.

7.2 Unless explicitly a different delivery period is agreed, we will ship your order usually within 1-3 business days (except Christmas holidays) from receipt of payment.

7.3 The delivery time is usually 1-5 business days (depending on country).

8. Payment

8.1 The Payment can be made by bank transfer in advance, credit card, cash or Paypal.

8.2 With the advance payment, we will provide our bank details in the order confirmation and deliver the goods after payment.

8.3 A right of set off is available only if your counterclaims have been legally established in court or are undisputed or acknowledged by us in writing.

8.4 You can exercise a right of retention only insofar as the claims from the same contractual relationship.

For the timeliness of the payment, the date of receipt is relevant to one of our accounts.

9. Payment

Until full payment the goods remain our property.

10. Guarantee

The warranty is subject to the statutory provisions.

 Dealer (B2B) have not a statutory right of withdrawal.

6.2 The shipping costs depend on the amount of goods ordered, the weight, the size and the shipping and will be clearly informed before submitting your order. You will find a list on the page Shipping. Assembly or installation are not included. For dealers the the free shipping rule does not apply.

7. Shipment

In the absence of any agreement to the contrary, the consumer shall bear the risk of transport in the case of deliveries. If the consumer is in default of acceptance, we shall be entitled to store the goods on our premises, for which we shall charge a storage fee of € 1 per calendar day or part thereof. At the same time we remain entitled to insist on fulfilment of the contract. However, we shall also be entitled to withdraw from the contract after setting a reasonable period of grace and to dispose of the goods elsewhere. Any purchase price already transferred shall be refunded minus the costs incurred by us.
